Christian advocate for women’s and children’s rights and founder of website Binary Kirralie Smith continues to be silenced by Australian courts.
Last December, she was placed under a two-year apprehended violence order (AVO) after an appeal overturned an earlier ruling in her favour.
A local magistrate originally denied the application in 2023, but the district court reversed that decision.
Ms. Smith has not been charged with any offence.
Veteran Christian campaigner Lyle Shelton who is national director of Family First writes in the Daily Declaration:
“Let’s set the record straight: Kirralie has never met, spoken to, or even publicly named the applicant.”
“Her advocacy has always focused on Football Australia and other sport governing bodies that allow males to compete in female divisions.”
“The only reference to the applicant was a publicly available photo, used to demonstrate that males are, in fact, playing in women’s competitions.”
“This ruling has far-reaching consequences. Words are not violence. Political advocacy is not harassment.”
Mr. Shelton continues: “This AVO effectively acts as a gag order, silencing Kirralie and setting a dangerous precedent for anyone who dares to discuss or speak out about the inclusion of males in female spaces, services, and sports.”
Last month Ms. Smith appeared in the Local Court of NSW over a separate, but similar matter.
Next month she will face a vilification case brought by a Sydney soccer player and trans activist.
Lyle Shelton points out: “This relentless lawfare is draining time, energy, and financial resources.”
“The process itself has become the punishment.”
He claims the applicants benefit from pro bono legal representation from government funded and government backed law services that are working to stifle Ms. Smith’s advocacy.
She has had to fund-raise every dollar of her legal costs of around $200,000.
Mr. Shelton writes: “Kirralie is on the front lines, fighting not just for herself, but for all Australians who refuse to be silenced.”
“If these activists succeed, they will set a precedent that allows the silencing and punishment of anyone — politicians, journalists, and everyday Australians — who dares to challenge their ideology.”
